Fluid Frontier Terms of Use

The short version
Fluid Frontier is made by Nicola Harvey. You are welcome to use it. The app is free to start, and some features are unlocked with a free trial and then a paid subscription, or a one time lifetime purchase. Your privacy stays protected, the way our Privacy Policy describes.
Your licence
We grant you a personal, non exclusive, non transferable licence to use Fluid Frontier on devices you own or control, for your own enjoyment. The app, its design, code, moods, palettes, and brand belong to Nicola Harvey. Please do not copy, resell, reverse engineer, or redistribute the app or its parts.
Free and premium
Fluid Frontier is free to download and use with a set of free moods and palettes. Premium features are unlocked in one of two ways:
- A free trial, then an auto renewing subscription (monthly or yearly), or
- A one time lifetime purchase that unlocks everything, with no renewal.
Subscriptions, trial, and billing
- New subscribers can start with a free trial. The length and the price that applies after the trial are shown to you before you confirm, on the purchase screen.
- Payment is charged to your Apple ID or your Google account at confirmation of purchase.
- A subscription renews automatically for the same period and price unless you turn off auto renew at least 24 hours before the current period ends.
- You can view, manage, or cancel your subscription at any time in your account settings on the App Store or Google Play. Cancelling stops the next renewal. The current paid period continues until it ends.
- If you start a subscription during a free trial, any unused part of the trial ends when the paid subscription begins.
- A lifetime purchase is a single payment with no renewal.
Refunds
Purchases and subscriptions are sold and processed by Apple or Google, not by us. Refund requests are handled by Apple or Google under their policies. Nothing here limits any right you have under the Australian Consumer Law or other consumer protection laws that apply to you.
Your content stays yours
Words you write and photos you bring into the water are yours. They stay on your device, with one exception that is in your hands: when you choose to send a design that has a photo in it, that design and its photo are stored briefly so a short link can be made, and deleted automatically after a year. The Privacy Policy sets this out in full. We do not claim ownership of anything you create. You are responsible for the words and images you choose to use.
Acceptable use
Please use Fluid Frontier lawfully and kindly. Do not use it to create or share content that is unlawful, harassing, or infringes someone else's rights, and do not attempt to break, disrupt, or misuse the app.
Consumer guarantees
If you are in Australia, our app comes with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies those guarantees. To the extent the law allows, and apart from those guarantees, the app is provided on an "as is" basis and our liability is limited to resupplying the app or the cost of resupply.
Changes
If we change these terms, the updated version will be posted here and, where it matters, called out in the app's release notes. Continuing to use the app after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Queensland, Australia.
